CPS Agrees to Pay $127k Sanction for Wrongful Removal of Children
After 5-month-old Mason Bright fell out of a chair and injured his head, his mother rushed him to the hospital. After the hospital discovered multiple skull fractures, they suspected child abuse and reported his parents to CPS.
Blood tests later determined that Mason likely had a blood clotting disorder which would cause excessive bleeding. In addition, a medical expert stated it was possible for one fall to result in multiple fractures. Still, CPS tried to have Mason and his sister removed from the home by placing them with relatives.
After the relatives experienced difficulty in caring for the children, Mason’s parents, who believed the placement was voluntary, informed CPS that they were bringing the children home.
The family did not hear anything from CPS until 3 weeks later, when a caseworker requested an update on Mason. Mason’s mother sent photos of Mason and a positive health update. The next day, without notifying the Brights, CPS obtained an emergency court order to remove the children, took both children, and placed them in foster care.
That decision was later reversed and CPS was ordered to pay $127,000 in sanctions and to provide new training for its caseworkers.
“It is not possible,” Judge Mike Schneider noted, “to look at the facts and imagine that the agency actually felt there was any sort of urgent need for protection to remove the children.”
