Charles and Linda Bachman’s daughter, Ella, had complex and ongoing medical needs. During a recent hospitalization for extreme allergic reactions, she required antibiotics, significant pain management, and eventually a transfer to a larger children’s hospital for more specialized care.
While Linda was asleep in Ella’s hospital room one morning, a CPS investigator entered and informed her there had been an allegation of abuse. Linda was told to leave the room while the investigator interviewed her daughter alone.
Linda contacted Heritage Defense from the hospital.
Our attorney advised Linda to make it clear that she was willing to cooperate but would not answer questions without counsel present. Linda obtained the investigator’s card and declined further discussion until an attorney could be involved.
We immediately contacted one of our local attorneys and assigned her to the case.
The attorney learned that the allegations included claims that Linda was interfering with Ella’s G-tube, possibly causing seizures, and mishandling Ella’s physical therapy. At the time, Charles and Linda were simply trying to stabilize their daughter’s condition and understand why she continued to experience complications.
Over the following weeks, the investigation continued. The family provided CPS with extensive medical records. The Bachman family experienced additional hospitalizations with Ella, and each time, CPS followed up. Investigators requested medical release forms, attempted further questioning, and sought to make contact with the Bachmans other children.
Our local attorney remained involved throughout the process. She reviewed documents before anything was signed, participated in phone and in-person interviews, and ensured the family understood what CPS could and could not require of them. The attorney also made sure the allegations were read directly from the report during the in-person meeting so the parents knew exactly what they were responding to.
Eventually, medical specialists, including a geneticist, confirmed Ella’s underlying and complicated medical condition that explained her symptoms. Her condition is rare and difficult to treat, which contributed to the repeated hospitalizations.
After multiple interviews and record reviews, Charles and Linda were vindicated and the allegations were determined to be unfounded.
Charles and Linda later received written confirmation that the investigation was closed, and there were no findings against them.
Charles and Linda shared their testimony:
Charles and Linda were seeking medical care for their daughter. When concerns were raised, they were grateful they had immediate legal guidance.
