Member Story: Hospital mistake leads to failed drug test

Terry and Maria Ward* planned to have their baby at a birthing center with a midwife. But when complications during labor arose, they transferred to the hospital for a c-section.

After a successful delivery, a social worker on staff at the hospital visited the Wards in their room with some concerns. She informed them that tests were indicating Maria had two different types of drugs in her system at the time of delivery. The Wards had no idea how this was possible. The social worker said the baby could remain in the room with them, but it was unclear whether the Wards were going to be allowed to take their baby home upon discharge.

The Wards immediately called Heritage Defense and were connected with an attorney who assisted the family. Eventually, the hospital admitted that they had mistakenly run the tests after giving Maria medication in preparation for the c-section. It was those drugs showing up in her system.

Soon after the hospital admitted their mistake, Terry and Maria were able to take their new baby home without any other issues.
