Member Story: Our daughter got into our medication.
Under the direction of their doctor, Mark and Tracy Kurby* sometimes take THC-free CBD oil to help them sleep. One evening, Mark took some right before they went to bed and left it on his bedside table.
The next morning, Mark and Tracy started doing their morning routine and getting their children up and dressed. Unfortunately, Mark forgot to put the CBD oil away and out of the reach of their four-year-old daughter, Hannah. While Mark and Tracy were busy with the other children and making breakfast, Hannah slipped into their bedroom and found the CBD oil.
Tracy noticed Hannah was missing, immediately started looking for her, and soon found her. But Hannah had already gotten into, played with, and swallowed some of the CBD oil. Tracy called poison control who told them to take Hannah to the hospital, which they quickly did.
Hannah was evaluated by the hospital staff who determined she was not in any danger. The hospital did a urine test, which came back CBD-positive. The hospital told Mark and Tracy that they would be filing a police report and a report to CPS. Because they were members of Heritage Defense, Mark and Tracy called the Heritage Defense urgent line and were quickly connected with an attorney. The Heritage Defense attorney advised Mark and Tracy how to handle the situation at the hospital.
Shortly afterward, a CPS investigator walked into Hannah’s hospital room and began asking Mark and Tracy questions about the rest of their children, their home, their educational methods, and other questions. Mark and Tracy answered how their Heritage Defense attorney had advised, and the CPS investigator left.
The hospital soon discharged Hannah, and the Kurbys went home. On the way home, they bought a secure box for all their medication.
Later that day, there was a knock at the door of their house. Mark answered it and was greeted by a CPS investigator. Tracy told the investigator that she was going to get her attorney on the phone and immediately called the Heritage Defense attorney.
The Heritage Defense attorney told the Kurbys to get the social worker’s business card; that they could let the investigator lay eyes on the children but not to answer any questions; and to tell the social worker that their attorney would be in contact. They did, and the investigator left.
The Heritage Defense attorney reached out to the investigator and soon received an email back from CPS demanding an interview with the children. Over the next few weeks, the Heritage Defense attorney went back and forth with CPS. Ultimately, the CPS investigator agreed to close the case without any home visit or interviews with the children.
Soon after, CPS sent an email to the Heritage Defense attorney informing him that CPS would be closing the case. The Heritage Defense attorney immediately contacted Mark and Tracy to inform them of the good news. Mark and Tracy said they felt a huge burden lifted from their shoulders when they heard the case was officially closed. They thanked Heritage Defense for their quick handling of the case:
“We appreciate how you handled it. It was resolved as quickly and in the best way we could have hoped. We really, really appreciate this. Definitely huge, huge, huge thanks. We’re very thankful for your defense and we’re grateful that everything ended up the way it did.”
